General Terms and Condition of Advertising on www.limun.hr
General terms and condition of advertising (hereinafter: GT&C) apply to advertising on www.limun.hr web page, owned by Raiffeisen Consulting d.o.o. Zagreb, Petrinjska 59 (hereinafter: RC).
The GT&C is available at the www.limun.hr web page.
RC reserves the right to change the design of www.limun.hr web page, including the banner placement. RC is obliged to notify the Advertiser about such changes at least 30 days before they take place.
Technical solution
All solutions applied in advertising on www.limun.hr web portal (excluding solutions applied from the Advertiser) are the sole ownership of RC and its contractual partners.
RC obliges to supply to each Advertiser with the Instructions for Banner Design, and ask from each Advertiser to follow them.
Contents
Advertiser shall bear all responsibility for the content and authenticity of the information in the advertisements displayed on www.limun.hr web portal.
Advertiser guarantees that all supplied material (advertisements) for display is their property, i.e. it has the right to use it for promotional purposes.
Exclusion of liability
RC is excluded from all liability for accuracy and authenticity of content and information published in the advertising space.
RC shall not be responsible for any damage, direct or indirect, material or immaterial, and/or lost profit caused by the inability to download and/or use, loss or modification of data and/or in other ways that are a consequence or result of interruption, inability to use, fault, or inadequate quality of telecommunication links used for data transfer. RC shall also not be responsible for any damage, direct or indirect, material or immaterial, and/or lost profit caused by malfunctions, loss or modification of data that occurred due to IT equipment malfunction, as well as faults in the operation of the operating system, interruptions in power supply, electric shocks and similar, that cause irregularities or interruptions, i.e. inability to deliver/display material.
Deadlines
Advertiser is obliged to submit to RC all material for publication of advertisements no later than three days before the start of the campaign.
RC is not obliged to publish any material received after this deadline.
Advertising space
It is not possible to lease purchased advertising space on www.limun.hr web portal to third parties, unless the agreed otherwise. Apart from leasing it, the Advertiser obliges not to display material (advertisements, logos) of third parties, unless agreed otherwise by the parties.
Advertisement display
In case the advertisement does not meet the technical specifications prescribed by RC, RC reserves the right not to display the advertisement.
If RC evaluates that the content of the material (advertisement) is in any way inappropriate or illegal, and if it leads to web pages of unsuitable content, RC reserves the right to deny display of such advertisement or discontinue their display.
Advertisement must not mislead web page users (e.g. advertisement design must not imitate Windows/Mac/Unix dialogue windows, error messages and so on).
Advertisement must not copy the content of www.limun.hr web portal. Advertisement must have a clear border or background that clearly marks the dimensions where the advertisement ends and the web page starts.
The advertisement must not contain elements that imitate interactivity (drop down menus, search boxes and similar) unless they truly have such a function.
Advertising discounts
Advertising discounts can be found in the official Advertising rates of www.limun.hr web portal.
RC does not charge advertising of humanitarian organizations and campaigns on its portal. Such advertisements shall be displayed in agreement with the Advertiser.
Complaints
All complaints about the displayed advertisement have to be made not later than 3 days after the advertisement is displayed, in written form only (mail, fax, e-mail).
After the expiry of the above period, it shall be considered that the Advertiser agrees with the displayed advertisement.
In case that RC is responsible for the complaint, the Advertiser shall be entitled to a new display of the same advertisement without additional fees.
If the error is a result of objective restrictions in regard to the nature of the media, or errors in advertisement preparation by the Advertiser, the complaint shall be rejected.
Advertising rates
Advertising rates are published on the www.limun.hr web page. They came into effect on November 1, 2010. RC withholds its right to change them.
Lease of advertising space
The confirmation of lease of advertising space is regulated with the Order Form signed by RC and the Advertiser. With the signature, the Advertiser confirms that he agrees with the Advertising rates published on www.limun.hr web page and the GT&C, and agrees to their application. Along with the signed Order Form, the Advertiser has to submit to RC a proposal of creative design for the advertisement.
Payment terms
RC shall issue an invoice to the Advertiser after the advertising service is rendered, or before the service is rendered, in case the advance payment was agreed. The Advertiser is obliged to make the payment no later than the date stipulated on the invoice. If the Advertiser makes the payment after the due date, RC shall charge the default interest.
Penalties
In case the Advertiser cancels the lease of advertising space within 48 hours prior to the start of the campaign, RC has the right to charge penalties in amount of 5 percent of the total lease amount.
RC shall not charge the Advertiser for all cancellations of advertising space lease by the Advertiser within 3 days prior to the start of the campaign.
Final provisions
General Terms and Conditions of Advertising on www.limun.hr apply to all Advertisers who sign the Order Form.
In case the GT&C provisions collide with the valid laws and bylaws, the provisions of the valid laws and bylaws shall be valid until the change and/or amendment of the GT&C.
RC withholds the right to modify the GT&C and publish it on www.limun.hr web page.
RC Management Board adopted the GT&C, and it came into effect on 15 July 2008.
